Over the limit, with four kids in the car

A Skegness motorist who was found to be more than twice the legal drink-drive limit had four young children in the car at the time of his arrest, a court has been told.

Kyle Williams, of Samuel John Way, admitted driving with excess alcohol when he appeared at Boston Magistrates’ Court on Wednesday.

The 32-year-old was stopped by police in Scampton Way at 9pm on December 21 because he was speeding and crossing the central white lines, the court was told.

Jim Clare, prosecuting, said Williams was arrested after he refused to take a roadside breath test, and then provided a reading of 72 microgrammes of alcohol in 100 millilitres of breath at the police station – more than twice the legal limit of 35mcg.

Mitigating, Beris Brickles said it had been a ‘spur of the moment decision’ to drive.

He said Williams’ partner had taken the children to a Christmas event and had intended to return by taxi, but decided to go out for the evening afterwards with a friend, who loaned Williams her car to take the children home.

“Foolishly he agreed to do so,” said Mr Brickles “and the consequence is that he risks his job which is as a driver at a recycling plant.”

He said Williams also often had to drive his children to and from school.

Williams was fined £197 and ordered to pay £117 in court costs and charges. He was banned from driving for 19 months but was offered the drink drivers rehabilitation course, which will reduce the period of the ban by 19 weeks.
