Ban for car chase driver who nearly killed pedestrian

A motorist who drove at twice the speed limit in a bid to evade police nearly killed a pedestrian when he lost control of his car, Lincoln Crown Court was told.

Kain Masey realised he had been spotted by police and accelerated away reaching 80 mph as he headed towards Skegness in his Renault Laguna on the afternoon of 18 April.

Chris Jeyes, prosecuting, said that Masey, who was banned from driving and wanted in relation to making off without petrol from a filling station in Nottingham, was pursued along Burgh Road into the town.

He drove on the wrong side of the road on occasions and at one point went straight through a red traffic light.

The officers abandoned the pursuit because it was too risky but Masey was picked up again as he headed away from Skegness along the A52 at Ingoldmells.

This time the pursuit lasted for 11 miles before Masey lost control and crashed near to the Sutton Springs caravan site at Trusthorpe.

Mr Jeyes said “He exceeded the speed limit on numerous occasions going at up to 80 mph in a 60 limited area and up to 50 mph where the limit was 30.”

Masey reached Trusthorpe where he took a roundabout the wrong way and again accelerated to 80.

An attempt to halt the car using a stinger device failed when Masey swerved round it but he then lost control.

Mr Jeyes said “He narrowly missed the stinger but lost control because of the speed he was going at.

“The Laguna was swerving from side to side and then collided with a wooden fence. It was estimated that he had been going at between 70 and 90 mph to avoid the stinger. The limit was 30.

“After hitting the fence the rolled over a number of times. A pedestrian was left in a state of shock. She had been walking along towards the main road. She saw there were police cars in the area. She didn’t know what was going on.

“She heard a car speeding towards her. She looked and it was completely out of control. She panicked and went to run. She saw the car was now coming towards her and began spiralling through the air. She was forced to throw herself to the floor as the car flew over her crashing into a house.”

Masey managed to get out of the car through the broken sun roof. He was arrested and then taken to hospital for treatment to injuries he suffered.

Masey, 25, of Wallis Street, Basford, Nottingham, admitted charges of dangerous driving, driving while disqualified, driving without insurance and possession of a cannabis. He was jailed for 16 months and banned from driving for two years and eight months.

Judge John Pini QC, passing sentence, told him “You very nearly killed this woman. I have very grave concerns that if you continue in driving like this you will kill one or more innocent members of the public.

“I have to protect the public from you and it is high time they were protected from you.”

Lauren Fisher, in mitigation, said that Masey has been diagnosed with a personality disorder.

She said that on the day of the incident Masey had smoked cannabis and a small amount of the drug was found on him when he was detained.

“He realises substance misuse has a negative impact on his mental health.”

Miss Fisher asked the court to consider imposing a suspended jail sentence adding “He has now had a period of custody on remand.

“It may be that this is the opportunity for him to get the help he so desperately needs.”
