Bassetlaw Council to be sentenced over pensioner death

BASSETLAW Council will be sentenced at Nottingham Crown Court on Monday over the death of a Langold pensioner who was hit by a council bin lorry.

Derrick Baines, 76, of Mellish Road, was returning home from the shops on his mobility scooter when he was struck by a reversing bin lorry on 10th July 2008.

The council is charged with breaching Section 3(1) of the Health and Safety at Work etc Act 1974, which states: “It shall be the duty of every employer to conduct his undertaking in such a way as to ensure, so far as is reasonably practicable, that persons not in his employment who may be affected thereby are not thereby exposed to risks to their health or safety.”
