Behind bars for Clowne assault

Luke Evans had lived ‘on and off’ at Charmaine Stanton’s Boughton Lane address for five months before the attack, a court heard.

The unemployed decorator had painted a child’s bedroom before drinking and a row blew up as the couple watched television.

Andrea Charity, prosecuting, told Chesterfield Magistrates that Evans, 29, pushed Miss Stanton backwards before punching her in the mouth.

He walked upstairs and, as she followed, he grabbed her throat and pushed her again, causing her to fall down eight steps on the staircase.

Evans then sat on top of her and punched her twice more before leaving.

She called police and went to her mother’s home.

Miss Stanton, who suffered a cut lip, told police: “I thought he had changed, but it’s every time he has had a drink.”

Evans, of Dawlish Court, Coniston Road, Newbold, Chesterfield, denied the 28th April assault but was convicted following a trial.

He had been cautioned by police for violence towards a previous partner in 2008 and had a conviction for damaging property during a domestic dispute.

Presiding magistrate Paul Beard locked him up for 24 weeks and imposed a restraining order banning him from contacting the mother-of-two.

He had spent six weeks in custody on remand for this matter and that period will be deducted from his sentence.
