Collision driver from Skegness so drunk he tried to sleep in road

A Skegness driver who laid down in the road after colliding with another car and was so drunk he could not give his name and address, gave a roadside breath test almost four times the legal limit but refused to give the evidential test at the police station.

Andrew Ogden, 45, of Denham Close, admitted failing to provide a specimen for analysis when he appeared before magistrates at Boston.

Marie Stace, prosecuting, said that at 8pm on May 26, police were called to a road traffic collision in Beresford Avenue between Ogden's Citroen and another car, causing extensive damage to both.

She said the officers found Ogden 'laid on the road trying to get to sleep' and 'very much under the influence of alcohol'.

She said he was picked up and was unsteady and very emotional and upset.

Ms Stace said he gave a positive roadside breath test reading of 136 microgrammes of alcohol, the legal limit is 35, and was arrested.

At the police station he was required to give two breath samples, the lower one being the one with which he would be charged, but he gave only one – with an even higher reading of 142 microgrammes of alcohol in his breath, then refused to give the second, saying 'he did not want to'.

Ms Stace said that despite several warnings he continued to refuse.

Mitigating, Daven Naghen said that 'clearly the level of impairment is very high', but pointed out that although police had said in their statement that Ogden was 'too intoxicated to give his address', they seemed to think he was 'not too intoxicated to refuse the breath test'.

He told the magistrates that Ogden has since scrapped his car and cancelled his insurance.Ogden was ordered to undergo an alcohol treatment order and 10 rehabilitation days.

He was also banned from driving for 18 months and ordered to pay £170 in court costs and charges.
