Man used WhatsApp to breach non-molestation order

A man who sent messages on WhatsApp to his former wife, admitted breaching a non-molestation order when he appeared at Boston Magistrates Court.

The court heard that David James Johnstone, 37, now living in Boston but who until recently lived in Skegness, was said to have been made subject to the order by Lincoln Family Court in May this year.

However, on July 14 and again on August 17, he sent messages to his former wife Kayleigh on the social media WhatsApp.

He alleged when interviewed by the police that she had contacted him first.

Anita Toal, mitigating, said it did appear as if the complainant had been contacting him and she had not blocked him from her phone.

She said he had now changed his phone number four times and had moved out of the area.

She said it was a 'minor breach' and suggested it would not have caused much distress.

The magistrates refused a prosecution request to issue a restraining order and fined Johnstone a total of £200 and ordered him to pay £117 in court costs and charges.
