Allan Daken denied sexually touching the girl but was found guilty by a jury following a trial.

Daken, 52, of Ruskington, pleaded not guilty to two charges of sexual assault of a child under the age of 13 as a result of the incident on December 6, 2014 but was convicted after his DNA was found in the girl’s underwear.

Judge Simon Hirst jailed him for three and a half years.

Mark Watson, prosecuting, told the jury Daken is married with children with no previous convictions or cautions but did “the unthinkable”.

He said: “He touched this 11 year old girl. It was short-lived. It was discreet. It was plainly sexual.

“Her reaction was one of confusion. She was, of course, an 11 year old child. She was a naïve girl who had no apparent knowledge of sexual matters.

The girl later told her parents what had happened and Daken was confronted but Daken continued to deny the matter when he was interviewed by police.

Items of the girl’s clothing were examined which provided evidence to back up the girl’s complaint and Mr Watson said: “Her pants were subjected to a scientific examination.

“What the scientists found was that there was a mixed DNA profile. There was DNA from more than one person.

“When they looked at that DNA they found it matched the DNA of the girl but it also matched the DNA of the defendant. This positively supports what the girl said.”
