Drunk man refused to leave

Staff at the Chinese take-away in Welbeck Street, Whitwell, complained that Matthew Morris had shouted abuse at them and kicked the counter.

They called police after he refused to leave and officers arrived after 8pm to find him perched on a window ledge, apparently asleep.

“They woke him up and he became abusive, shouting: ‘What do you want? I’m not going anywhere with you’,” John Cooper, prosecuting, told magistrates at Chesterfield.

“His speech was slurred and he smelled of alcohol and they formed the opinion he was drunk,” he continued.

Morris, 41, was handcuffed by officers and placed in a police van.

He later gave an address in Worksop but his ex-partner said they had split up and he was homeless.

“He shouted and waved his arms around in the police station and he was taken to a cell,” added Mr Cooper.

Morris, of no fixed address, admitted drunk and disorderly behaviour on 1st June.

The court heard that he had previous convictions for burglary, shoplifting and damage - mainly committed in the Worksop and Retford areas - and had served time in prison in the past.

Morris apologised for the offence and told the court he gave a zero alcohol reading when he was breath-tested at the police station.

He was fined £50 for the offence and ordered to pay £85 prosecution costs.
