Whitwell drink-driver in court

A WHITWELL man was found drunk in charge of his car following a trip to a graveyard.

A court heard how Brian Layhe will lose his job in middle management if he is banned from driving for the offence.

His wife Nicola phoned him at 6.30pm on 16th March to say his dinner was ready. He told her he was at a cemetery looking at some graves and he would be home within an hour. The 50-year-old then called her at 8pm, saying he would set off in five minutes time, and she believed he was drunk, Chesterfield magistrates were told.

Police were informed and Layhe, who fell asleep in the driver’s seat after drinking vodka, became aggressive following arrest, said Fernando Rodrigues, prosecuting.

He added that a breath test indicated Layhe had drunk three times the legal limit.

Layhe, of Butthill Close, Whitwell, admitted being in charge of a vehicle while unfit through drink or drugs.

Sentencing was adjourned until 26th April for probation service reports and he was granted bail on condition he did not contact his wife, who lives in Langold.

The court heard that Layhe had worked at the same Leeds factory for 26 years, and he would be unable to get there and back by public transport.

District Judge Andrew Davison warned Layhe that he could be disqualified from driving at the next hearing.
