Lee Torrance, 30, of Holmefield Road, was sentenced at Mansfield Magistrates’ Court on Thursday 14th November.

He pleaded guilty to the offence at a previous hearing.

The court heard that Rajesh Vasudevan, owner of the Ryton Off Licence, handed his iPhone 4 to his daughter to look after whilst he was serving customers.

She had been using the phone for most of the day before her father asked if she could give him it back.

His daughter did not know where it was and so Vasudevan decided to check the CCTV and it showed Torrance taking the phone. Vasudevan said that he did not recognise Torrance and called the police.

The court heard that Torrance believe he would get around £200 for the phone when in fact Vasudevan valued it at around £60.

In mitigation, David Verity, said: “Lee Torrance is a man who suffers with epileptic fits and has a number of medical problems.”

“Having stole the phone, he gave it somebody who then went to Manchester. Around four weeks later, Mr Torrance recovered the phone and returned it and apologised.”

Torrance committed the offence whilst also subject to a conditional discharge for two previous thefts.

The magistrates sentenced him to 18 months supervision, a three-month curfew between 7am and 7pm, ordered him to complete a Thinking Skills Programme and must pay £85 costs and a £60 victim surcharge.
